Nevertheless, species protection examinations are one of the main risk factors in the development of wind energy projects. A clear legal regulation is still lacking, and authorities and courts interpret the regulations in an inconsistent manner. Compliance with species protection law is subject to increased judicial review by environmental associations in particular.
